These terms govern access to and use of SafyTech websites, software, APIs, messaging integrations, and related services (collectively, the "Services"). By using the Services you agree to these Terms & Conditions and our Privacy Policy.

Who we are

The Services are provided by SafyTech ("SafyTech", "we", "us", or "our"), a SaaS product engineering company based in India. Contact details appear at the end of these terms.

Eligibility and accounts

You must be able to form a binding contract under applicable law to use the Services. You are responsible for maintaining the confidentiality of account credentials and for all activity under your account. You agree to provide accurate, current information when registering or contacting us.

Scope of the Services

The Services may include, without limitation:

  • Our public websites and marketing properties at safytech.dev and related domains.
  • SaaS products and tools we offer, such as MERN Ease and SafyMonitor, including updates and documentation we make available.
  • APIs, integrations, automation, and messaging features (including WhatsApp Business or similar channels) where we provide or enable them on your behalf.
  • Professional services, support, or consulting when expressly agreed in writing.

Features, availability, and pricing may change over time. We may suspend or discontinue parts of the Services where reasonably necessary for security, legal compliance, or operational reasons, with notice where practicable.

Acceptable use

You agree not to misuse the Services. Without limitation, you must not:

  • Violate applicable laws, third-party rights, or platform rules (including Meta or WhatsApp policies when using those channels).
  • Attempt to gain unauthorized access to systems, data, or accounts, or probe or test vulnerabilities without authorization.
  • Transmit malware, spam, or deceptive or unlawful content through the Services.
  • Reverse engineer, scrape, or overload the Services in a way that impairs stability or security, except where mandatory law allows.
  • Use the Services to build a competing product by misappropriating our confidential information or trade secrets.

Customer data and privacy

You retain rights in data you submit to the Services, subject to the rights we need to operate, secure, and improve the Services. Our collection and use of personal information are described in our Privacy Policy. Where you use messaging or social platforms, you are responsible for lawful consent, opt-outs, and content standards required by those platforms and by law.

Intellectual property

SafyTech and its licensors own all rights in the Services, including software, branding, documentation, and aggregated non-identifying analytics. Except for the limited right to access and use the Services as offered, no rights are granted to you by implication. Feedback you provide may be used by us without obligation or restriction.

Third-party services

The Services may rely on or link to third-party services (for example cloud hosting, analytics, payments, Meta, or WhatsApp). Those services are governed by their own terms and policies. We are not responsible for third-party services we do not control.

Fees and trials

If you purchase paid Services, fees, billing cycles, and taxes will be as stated at checkout or in an order form. Unless otherwise agreed, fees are non-refundable except where required by law. We may change prices with reasonable notice for subsequent renewal periods.

Warranties disclaimer

The Services are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, SafyTech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amounts you paid to SafyTech for the Services in the three months before the claim or (b) INR 5,000, except where liability cannot be limited by applicable law.

Indemnity

You will defend and indemnify SafyTech and its directors, employees, and affiliates against third-party claims, damages, and costs (including reasonable attorneys' fees) arising from your use of the Services, your data or content, or your breach of these terms, except to the extent caused by our willful misconduct.

Suspension and termination

We may suspend or terminate access to the Services if you materially breach these terms, create risk or legal exposure, or if we cease offering a Service. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination (including ownership, disclaimers, limitation of liability, indemnity, and governing law).

Governing law and disputes

These terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India will have exclusive jurisdiction over disputes, subject to any mandatory rights you have under local consumer law.

Changes

We may update these terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may be communicated by email or in-product notice where appropriate. Continued use after changes become effective constitutes acceptance of the revised terms.
